How Spanish judicial auctions work

Spanish judicial auctions are conducted online through the official portal subastas.boe.es, operated by the Agencia Estatal Boletín Oficial del Estado. All auctions follow a standardized 20-day online bidding period. Properties come from judicial proceedings (courts), tax collection (Agencia Tributaria), and social security enforcement. The system is fully digital — no in-person attendance required.

The bidding process

To participate, you need a digital certificate (certificado digital) or DNI electrónico. Register on subastas.boe.es and deposit 5% of the asset's value (consignación) via bank transfer. Bidding runs for exactly 20 calendar days. You can place multiple bids, and all bids are binding — you cannot retract a bid once placed. The highest bidder wins, but the court can reject bids below certain thresholds.

Minimum bid thresholds

For residential properties (vivienda habitual), the minimum acceptable bid is 70% of the appraised value. For other properties, it's 50%. If no bid reaches the minimum, the creditor has the option to accept the highest bid or request a new auction. In practice, many properties sell at or near the minimum threshold, offering 30-50% discounts from appraised values.

After winning

The winning bidder must pay the remaining balance (95%) within 20 working days. The court issues an auto de adjudicación (court decree of award), which is registered at the Registro de la Propiedad. Transfer taxes (ITP) of 6-10% apply depending on the autonomous community. Existing tenants may have occupancy rights, and the buyer is responsible for any outstanding community fees (gastos de comunidad).
